SERVICE AGREEMENT

- Cibra Internet Services and Information Technologies (referred to as Cibra Hosting) and / or Cibra Hosting Web Site (www.cibrahosting.com) by accepting the terms and conditions of this agreement. Cibra Hosting has no criminal and legal responsibility for any kind of material / moral damages that may arise from your failure to read these terms or to act in compliance with them even if you have read them.

- Cibra Hosting reserves the right to update and amend this agreement at any time without prior notice.

- Any information, statistical form and value in the Cibra Hosting Web Site is compiled from sources that are accepted within the framework of general practices and their accuracy and competence are not guaranteed by Cibra Hosting in any way. Cibra Hosting shall not be liable for any personal, legal and / or personal damages arising from the direct or indirect material and / or moral negative and / or positive damages and possible other damages and expenses that may arise as a result of the use of the information, evaluation, comments and statistical forms and values ​​on the Cibra Hosting website. does not have criminal responsibility.

1.) Orders and Service Delivery

Your account will be set up and sent to you after your order has passed the fraud check and your payment has been received. Credit card and PayPal payments, domain name, web hosting and reseller hosting accounts are automatically installed, but in case of a possible problem installation process can be up to 48 hours. For payments made by wire transfer or EFT to our bank and postal check accounts, the setup period is determined as maximum 2 working days. For VDS and leased server services, installation time is 48 hours unless otherwise specified. The delivery period of the software and license services is maximum 1 week unless stated otherwise in written or oral form. If no delivery is made within the specified time, Cibra Hosting has an obligation to refund your fee if requested.

It is your responsibility to provide a trouble-free e-mail address that you actively use when ordering. In case of any violation or if we need to contact you, the e-mail address you provided will be used. It is your responsibility to keep your e-mail address constantly up-to-date and check, all e-mails sent to you are deemed to have been received. Cibra Hosting has no legal and penal liability for any damages and losses that may occur if the e-mails sent to you do not reach you or they are not read by you.

All the information you fill in the form must be accurate and complete when ordering or registering on our site. Cibra Hosting reserves the right to refuse or partially refund the orders canceled due to incorrect information.

Cibra Hosting may request a credit card photocopy / scanned image or ID photocopy / scanned image for security purposes if deemed necessary. If you do not provide them, your order may be canceled and counterfeited or the services you receive may be stopped. Cibra Hosting reserves the right to refuse or partially refund for accounts suspended for fraud.

Site Migration

Cibra Hosting does its best to move your site to Cibra Hosting for services that are guaranteed to move your site. However, Cibra Hosting does not guarantee that your site will be moved or how long your site will be moved, as site migration is an unclear process. Not every hosting company has a different configuration and / or some hosting companies do not have the conditions to move the site, so sometimes it can be very difficult or impossible to move your site accurately / completely / without error. Your site may be moved incorrectly and / or may not be moved at all. Cibra Hosting has no legal and penal liability for any damages that may arise from this situation.

2.) Content

The conditions of all services provided by Cibra Hosting is regulated by the Constitution of the Republic of Turkey.

By using the services provided by Cibra Hosting, you cannot assume any legal responsibility of Cibra Hosting, and you are solely responsible for all actions you take using the services provided to you.

It is prohibited to infringe any copyright or registration rights using our Services. This includes unauthorized music, books, photographs or other copyrighted material. Also, by law, pornographic / erotic content and content available for hacking cannot be hosted. Selling and / or hosting pornographic / erotic content contrary to the copyright / registration rights will result in the termination of the service (s) you receive as soon as possible. In the event that content that is in violation of copyright / registration rights and / or hacking is found, this content will be deleted or access to the content will be blocked. In the repetition, the service may be suspended / terminated. If you believe that such content is hosted using the services offered by Cibra Hosting, you can complain by sending an e-mail to abuse@cibrahosting.com. Cibra Hosting may request further information / documents / documents from you regarding your complaint.

Complaints about illegal actions using Cibra Hosting's services may not be terminated if Cibra Hosting is unable to verify the cause of the complaint or is unsure whether the action constitutes a crime. Cibra Hosting is not legally authorized to decide. In such cases, you must legally seek your rights against the person performing this action. Cibra Hosting has no legal and penal liability for any loss or damage that may occur in such cases.

All services offered by Cibra Hosting are for use only within the limits you are permitted to. If, in any way, you access any content / file / service that you are not permitted to, you are responsible for notifying Cibra Hosting without using it. Otherwise, it is your responsibility to cover any material / moral damages you may incur.

Cibra Hosting; may monitor site contents and / or any access for legal reasons, for system administration, for monitoring unauthorized access, for verifying security procedures and / or for operational security. During the follow-up, the contents / information may be tested, recorded, copied or used for the purposes described above. Cibra Hosting does not use or share your content in any way for the purposes described above.

Cibra Hosting reserves the right to provide services to any person or not to provide services to any person. Cibra Hosting; has the right to prevent the deletion / access from our servers by warning or not warning the contents that are contrary to the contract, provocative, divisive, illegal or inappropriate. In such cases, Cibra Hosting reserves the right not to refund or partially refund.

You are responsible for the services you receive from Cibra Hosting that the software / scripts / programs installed in your account are secure and that the permissions granted to the directories are correct. Users are responsible for any transaction performed on their account. This responsibility includes the user name and password. You must use a secure and unpredictable password for your accounts. You are also responsible for all malicious software that will be installed on our servers in any way using your account. Where necessary, Cibra Hosting reserves the right to terminate your services without refund or partial refund. Cibra Hosting shall not accept any legal and penal liability for any material / moral damages that may occur in this regard. You are responsible for compensating all material / moral damages incurred by Cibra Hosting and / or other users using your account.

Cibra Hosting reserves the right to ask you to modify any website, database, account or any other material / service.

3.) SPAM

Cibra Hosting does not tolerate unsolicited e-mail, bulk e-mail and spam e-mails. If you do not comply with this issue, the service (s) you receive will be terminated with / without notice. All services that cause our IP block to be included in the e-mail black lists will be terminated without notice.

Cibra Hosting, if the IP block enters the e-mail blacklists, the cause of this situation is entitled to charge the fee necessary to correct this situation. This fee is independent of Cibra Hosting and will be used to clear the IP block from e-mail blacklists. By receiving services from us, you agree that in such cases you will pay the required fee without any objection within the requested time.

4.) Payment

As long as you receive services from Cibra Hosting, you agree to pay Cibra Hosting for the service you receive. Unless you cancel the service you receive, the service will continue to be renewed and an invoice will be generated for the service you will receive. If you do not wish to continue receiving services, you must indicate that you wish to cancel at least 15 days in advance, so that your service will be canceled at the end of the day or after the time you have paid for it.

Service cancellation must be made from your client panel. The cancellation page provides options for canceling the service as soon as possible or expired.

Cibra Hosting reserves the right to provide legal fees for unpaid accounts unless canceled 15 days in advance.

As long as you receive services from Cibra Hosting, you are responsible for keeping your payment information up-to-date and paying your bills on time. If the invoice is not paid on time, Cibra Hosting will provide an additional 6 days for the payment of the invoice for web hosting and reseller hosting accounts and your service will be suspended at the end of this period. The service will be terminated 30 days after the due date. Your account will be terminated immediately if no payment is made on the last payment day for domain name, VDS and leased server services. Cibra Hosting shall not be held responsible for any material / moral damages and data loss that may arise in this regard.

Accidental and / or intentional overpayments will be added to your account as a credit and will not be refunded for any reason. You can redeem this added credit for future services from Cibra Hosting.

Cibra Hosting reserves the right to change the prices of the products at any time without notice.

Cibra Hosting, the disk space you buy, traffic and similar resources, if the amount used more than the amount of resources used, will charge you. In such a case, you have the responsibility to pay the required fee without any objection within the requested time. If not, your account will be terminated without a refund and Cibra Hosting will not be liable for any material / moral damages and data loss.

It is your responsibility to cover all material and moral damages incurred to Cibra Hosting in the event of withdrawal of fees (dispute, chargeback, etc.) with the exception of Cibra Hosting's knowledge and / or permission.

5.) Backup and Data Loss

You are responsible for all your data when using our Services. Cibra Hosting offers backup service for your convenience and does not guarantee any backups. Cibra Hosting is not responsible for any loss of data you may experience for any reason.

6. Cancellation and Refunds

Cibra Hosting reserves the right to terminate any service at any time with or without notice, without reimbursement or partial refund, without giving reasons.

Insulting / rude to any of our employees will result in the suspension / termination of your account / service. In such case, your membership will be terminated and the contract will be terminated without a refund.

If you receive services from Cibra Hosting, Cibra Hosting or its employees against any commercial reputation damaging comments, behavior, announcements, banners, articles, promises that you will avoid such actions. In the event of any contrary act, you acknowledge that you are liable for pecuniary and non-pecuniary damage and that the Istanbul Courts and the Enforcement Offices are competent in all cases.

Sites that attack our servers indirectly or directly and / or cause problems such as slowdown / downtime, attack sites can be terminated without notice and refund. In such cases, Cibra Hosting may ask you to cover the damages incurred. In such a case, you have the responsibility to pay the required fee without any objection within the requested time.

For paid services, in case of cancellation of the service before the expiry of the service period (for reasons of use contrary to the service contract, user request, etc.), the entire service fee or the unused period will not be refunded. You may use the credit on your account for services you may receive from us, but no refund or credit will be added to services terminated early.

7a.) Use of the Service

7aa.) Web Hosting / Reseller Hosting

Disallowed actions:

a) For any reason, it is strictly prohibited to send bulk e-mails and send SPAM e-mails in any way. E-mail services are available only for your normal correspondence.

b) Use of resources above 25% for more than 90 seconds is prohibited. There are many activities that can cause problems, including CGI software, FTP, PHP, HTTP, etc. Resource usage reports are determined by Cibra Hosting and Cibra Hosting is not required to provide any evidence of your use of resources.

c) It is forbidden to use an average of more than 5% per day for web hosting accounts and more than 12% per day for reseller hosting accounts. There are many activities that can cause problems, including CGI software, FTP, PHP, HTTP, etc. Resource usage reports are determined by Cibra Hosting and Cibra Hosting is not required to provide any evidence of your use of resources.

d) It is forbidden to run any offense-based program on our servers. Server-based programs such as IRCD.

e) Running spider or indexer programs such as Google Cash / AdSpy is forbidden.

f) It is forbidden to run any software that communicates with IRC (Internet Relay Chat) networks.

g) It is forbidden to run any proxy.

h) It is forbidden to run any bit torrent application. You can link to legal torrents outside our servers, but you can't host them.

i) Any file sharing / peer-to-peer application cannot be run.

j) Game server applications such as Counter-Strike, Half-Life, etc. are forbidden.

k) Running cronjob applications at intervals of less than 15 minutes is prohibited.

l) It is forbidden to run file sharing software (eg rapidshare etc ..).

i) Running audio stream / video broadcast applications is prohibited.

ip Each web hosting account is limited to a maximum of 250,000 files. Accounts with more than 100,000 files are not backed up by us.

7ab.) VDS / Dedicated Server

Unpermitted actions:

a) In VDS services, it is not possible to use intensive resources in any way to harm other VDSs. This problem is usually caused by intense disk activity.

b) It is forbidden to run any proxy application.

c) It is prohibited to operate any bit torrent application. You can link external torrents to legal torrents, but you can't host them.

d) Any file sharing / peer-to-peer application cannot be run.

e) Game servers such as Knight Online, Counter-Strike, Half-Life, etc. are forbidden.

7b.) Backup Limit

The service / services received by customers who make continuous backups can be suspended / terminated with / without notice. This clause applies if the server is damaged by using the backup service for purposes other than backup.

7c.) Unlimited Web Hosting

a) Unlimited web hosting services include hosting only the files of your websites and traffic of your website only.

b) Unlimited web hosting space cannot be used for data storage and / or backup space.

8.) Traffic Usage

You will have a certain traffic limit depending on the package you purchased. If this limit is exceeded / exceeded, purchased services / services may be automatically suspended until the next month or until more traffic is purchased. You are responsible for tracking the traffic used. Unused traffic cannot be transferred to the next month. Any use made on the traffic you purchase will be invoiced the following month and you agree that you will pay this fee within the requested period without objection.

9.) Uptime Guarantee

If the 99% uptime guarantee guaranteed by Cibra Hosting is not fulfilled, Cibra Hosting is responsible for providing one month of free use of the related service upon your request. Uptime reports from third party monitoring software do not apply to Cibra Hosting, Cibra Hosting maintains and publishes uptime reports itself. In case the Uptime guarantee is not fulfilled, you should send an e-mail to bilgi@cibrahosting.com to add credit to your account. In VDS and leased server services, only the network is warranted and Cibra Hosting is not responsible for the availability and / or availability of your VDS or leased server. In such cases, Cibra Hosting will not be aware of the problem unless you report it. If the Uptime warranty is not fulfilled, the discount to be provided in VDS / Dedicated server services does not cover 3rd party software / license fees.

The Uptime warranty does not apply to malicious attacks on the server to prevent the server from being shut down and during the specified server maintenance. For this reason, any interruptions will not be reflected in the uptime ratio.

10a.) Support Coverage

You agree that Cibra Hosting will not provide any support for issues not covered by the service you receive. Cibra Hosting has no obligation to provide software support and user transactions (opening mail account / setting up mail, creating database, etc.) for any hosting service received. In VDS / leased server services, only support is provided for making the system the first delivery, additional software installations-user operations are not covered. For software services, Cibra Hosting is only responsible for delivering software that runs smoothly.

In order to benefit from the support system, you must log in to your customer panel with your password and send a support notification from your Support Notifications section. In other ways (e-mail, phone, live support, contact form, etc.) any information about the account is not shared, no action is taken.

10b.) 24/7 Support

The 24/7 support concept doesn't mean you get instant answers to your support notifications every time you call. Our support team tries to respond to your notifications as quickly as possible. 24/7 support means that you work independently of working hours, and depending on the intensity of the support team, the response to your support statement is up to 24 hours unless exceptional circumstances occur.

11.) Reseller Hosting: Customer Responsibility

If you're getting a Reseller hosting account, you're responsible for supporting your own customers. Cibra Hosting will not support customers of reseller hosting users. If the customer of any reseller hosting contact us, Cibra Hosting reserves the right to suspend your account until you are interested in your own customer. In addition, our reseller hosting users are responsible for the content of their customers' sites. Cibra Hosting shall not be held responsible for any illegal behavior or contractual behavior of the customers of reseller hosting users.

12.) VDS and Dedicated Hosting

Cibra Hosting reserves the right to reset the password of any VDS or leased server service it offers. It is the customer's responsibility to keep a valid e-mail address and root password in our system. VDS and leased servers are not backed up by us, it is the customer's responsibility to back up all data and data.

13.) Co-Location

Cibra Hosting reserves the right to reset your server's password in a server hosting service. It is at the customer's request to store a valid email address and root password on our system. The hosting service area is not backed up by us, all information and clear.

Cibra Hosting reserves the right to hold pledges arranged in conjunction with the legal interest of the payment in the server and other fields within the payment delays that may occur in server hosting services.

14.) Price Change changes

You will not be charged an additional fee for the service you purchase during the service period you purchase, when you want to purchase an additional feature or where you want to use the allowable limits in size. Cibra Hosting reserves the right to change prices at the end of the service period and renew the service with new pricing.

15a.) Coverage

By taking service from Cibra Hosting, we accept that you will not harm Cibra Hosting in any way, you will not cause any material / moral damages and you can search for any material / moral damages.

15b.) Legal Requirements

By accepting services from Cibra Hosting, we agree not to give any legal obligation to Cibra Hosting. In the meantime, we are committed to seeking all court and attorney fees within the requested time.

16.) Disclaimer Disclaimers

Cibra Hosting is responsible for any damages your business may suffer. Cibra Hosting, we do not offer service / no guarantee. Data loss, delays, interruptions, erroneous information were handed over by Cibra Hosting and any Cibra Hosting personnel.
